Medtronic Lead Recal Mess

This is the bill introduced in the Senate last year to overturn Medtronic v. Riegel. A similar bill was introduced in the House of Representatives about six months ago. If you look at the Senate bill, you will note that one of the cosponsors was the junior Senator from Illinois. Is President-elect Obama still with medical device victims?

In Bruce Springsteen’s song Jungleland, the police wrongfully shoot and kill the song’s hero. Yet his girlfriend just “sets out the bedroom light” and the “poets down here don’t write nothing at all.” Little did I know in high school that this song was going to relate to a mass tort medical device claim like the Medtronic defibrillator lead litigation.
Hundreds of thousands of people who have defective wires in their chests are barred from bringing a claim and Congress can step in and fix it. Yet when I go to Google News and search for “Medtronic Congress Bill” I get nothing, which means there is nothing current with these search terms. Where is the outrage and the demand for Congress to fix this? Can I get an editorial from someone other than me? Why is this not a larger media story?

Let’s set aside whether the allegations against Medtronic are true for a second. Let’s assume they are. Plaintiffs allege that Medtronic made a lead wire that was different from the one that went through the clinical trial process that was approved by the FDA. The wire is grossly untested and recalled. People are killed. Medtronic should have responded quicker to the information that was available and recalled the product sooner.

Yet even if all of that is true, Plaintiffs cannot bring a lawsuit because the FDA approved the product. It is utter insanity that public discourse on preemption in this case is nonexistent.

    My life has been ruined since my difibulator has misfired in june of 2006..I can no longer travel long distances, see my grandchildren, return to work..my personal life with my girlfriend has been ruined. Now i just found out that medtronic sent letters, Oct 17,2007 to people who received defective leads, the hospitals and doctors who implanted them, advising them of a recall..

    as of the date above i have not received the recall notification from medtronic, have not heard from the hospital,nor the doctor who did the original implant and the follow up replacement with another defective lead. to further ad insult to injury when the difib misfired the doctor tried to blame me, saying that I must have dislodged the wire.. what I want to know is where is my day in court. Its is only fair that people who were injured should be compensated

    Listen. You know that Obama and most congressmen owe Medtronins for backing their relection runs. Get real. There is no way Obama or his people is going to let Medtronics lose a dime even if their products kill 10,000 of us. Ive had 4 operations since this thing almost killed me and need a heart transplant. Lawmakers couldn’t care less as I can’t put millions in their pockets. Wake up people! Have you checked the stats? Atleast 3.0% of us will die from these defective wires over the next 5 years. No one else will get a dime and no one will go to jail. I call it murder for profit. Medtronics call it tough luck. But then we voted these people in office. Question is when are we going to get them out. Give a crook a gun and he’s going to rob you.

    I have been looking to see what is going on with the appeal in the Federal Appeals court in St. Louis. ait was my understanding that they were going to hear arguments on
    April 12, 2010. Did this in fact happen and when are they going to render their opinion.

  • I have a Medtronics Sprint Fidelis lead implanted. It is possible that it is defective and has killed others alrady. It worries me for several reasons.

    I often woke up to my eight-year-old hugging me and crying in the middle of the night. He’s just checking to see that I’m still there. It drives me crazy, I can think of nothing else than this defective computer causing my death like it has others. Absolutely kills me. I cannot bear the thought of my son, who is now 12, waking up some morning and finding me dead.

    Now, After five years of constant mental anguish, Medtronics has offered to settle with me. I had to tell them I’d keep the settlement a secret. They sent me a check for $357. I must mean a lot to them. Think I kept the check?
